Introduction

Welcome to Pivit. These Terms of Service ("Terms") govern your access to and use of getpivit.com (the "Site") and the purchase of Pivit™ products. The Site is operated by, and the products are provided by, Olfactive Biosolutions Inc. (referred to hereafter as "Olfactive Biosolutions", "we", "our", or "us"). By visiting our Site and/or purchasing something from us, you engage in our "Service" and agree to be bound by the following Terms.

If you do not agree to all the terms and conditions of this agreement, then you may not access the website or use any services.

Order Placement and Acceptance

  1. Offer to Purchase:Your order is expressly conditioned on your acceptance of this Agreement. You agree that your order is an offer to buy, under these Terms, all Pivit products listed in your order.
  2. Order Acceptance:All orders must be accepted by us, and we are not obligated to sell the products to you. We reserve the right to decline or reject any orders in our sole discretion.
  3. Contract Formation:After receiving your order, we will send you a confirmation email containing your order number and the details of the items you ordered. Acceptance of your order and the formation of the contract of sale between Pivit and you will not take place unless and until you have received this order confirmation email.
  4. Payment and Processing:Payment must be received by Pivit prior to our acceptance of the order. Pivit may require additional information if you have not provided all required details, and we may cancel or limit an order at any time after it has been placed. Once a properly completed order, your payment authorization, and the funds have been received, we will locate your product(s) and arrange for shipment.
  5. Availability:All items are subject to availability. We will promptly inform you if the Pivit product(s) you have ordered are unavailable, and we may offer you an alternative product of equal quality and value.

 

Non-Commercial Use Only

  1. Personal Use Guarantee:Pivit only accepts orders for non-commercial use. You may not resell items offered on our website without Pivit’s express written consent.
  2. Policy Violations:If Pivit discovers that you are placing orders with the intent to resell items, or are otherwise using or intending to use the products inappropriately or illegally, we may immediately cancel your order, suspend or terminate your account, and pursue any and all available legal remedies from you under applicable law.
  3. Fraudulent Activity:To the extent your conduct may be fraudulent—such as purchasing products through the use of fake or stolen credit cards—Pivit will actively report you to federal, state, and/or local law enforcement authorities.
  4. Legal Compliance:It is your responsibility to understand and obey all applicable local, state, federal, and international laws regarding the possession, use, and sale of any item purchased from this website. By placing an order, you represent that the Pivit products ordered will be used lawfully.

 

Medical & Health Disclaimer

  1. Not Medical Advice:The products and claims made about Pivit on or through this Site have not been evaluated by the United States Food and Drug Administration (FDA) and are not approved to diagnose, treat, cure, or prevent disease.
  2. Consult Your Physician:The Site is not intended to provide medical advice. Before starting any weight loss program or using any dietary supplement, including Pivit, you should consult your doctor or healthcare professional, especially if you are pregnant, nursing, have a medical condition, or are taking any medication.
  3. Individual Results May Vary:Weight loss results discussed on this Site are not typical and may vary depending on individual metabolism, diet, and exercise.

 

Subscriptions, Billing, and Cancellation

  1. One-Time Purchases:If you purchase a single jar of Pivit, you will be billed once for the cost of the product plus applicable shipping and taxes.
  2. Subscription Program:By enrolling in a Pivit subscription, you agree to recurring, automatic billing. You will be billed immediately for your first order, and subsequent orders will automatically process on the interval you selected (e.g., every 30 days) to the payment method you provided at checkout.
  3. Cancellation Policy:You may cancel your subscription at any time. To avoid being charged for your next shipment, you must cancel at least 48 hours before your next scheduled billing date. You can cancel your subscription by logging into your account on our Site or by contacting customer support at pivot@getpivit.com.
  4. Price Changes:We reserve the right to change the price of our subscriptions. If we do, we will provide you with advance notice, and you will have the opportunity to cancel before the new price takes effect.
  5. Tax or Charges for Shipping and Handling.The posted price does not include taxes or charges for shipping and handling. All such taxes and duties will be added to your merchandise total, and will be itemized in your shopping cart.
  6. US Sales Tax.Pivit is required to collect applicable state and local sales tax on orders shipped to certain states within the United States. Taxes apply to most merchandise, but some states exclude certain items, like food products. Some taxing authorities also require the taxable amount to include any shipping and handling charges, while others charge sales tax only on merchandise. Pivit is required to follow the rules of each state. Your final order total, as set out in the checkout page of your shopping cart, will include the appropriate state and local taxes.

 

General Conditions

We reserve the right to refuse service to anyone for any reason at any time. You understand that your content (not including credit card information), may be transferred unencrypted and involve (a) transmissions over various networks; and (b) changes to conform and adapt to technical requirements of connecting networks or devices. Credit card information is always encrypted during transfer over networks.

 

Accuracy of Billing and Account Information

We reserve the right to refuse any order you place with us. We may, in our sole discretion, limit or cancel quantities purchased per person, per household, or per order. In the event that we make a change to or cancel an order, we may attempt to notify you by contacting the email and/or billing address/phone number provided at the time the order was made. You agree to provide current, complete, and accurate purchase and account information for all purchases made at our store.

 

Return and Refund Policy

We stand behind our products with a generous satisfaction guarantee. For quarterly (90-day) subscriptions, you have a full 90 days to try Pivit risk-free. For monthly subscriptions and one-time purchases, you have 30 days. Email pivot@getpivit.com and we'll process a full refund. No questions asked.

Prohibited Uses

In addition to other prohibitions as set forth in the Terms of Service, you are prohibited from using the site or its content: (a) for any unlawful purpose; (b) to solicit others to perform or participate in any unlawful acts; (c) to violate any international, federal, provincial or state regulations, rules, laws, or local ordinances; (d) to infringe upon or violate our intellectual property rights or the intellectual property rights of others; (e) to submit false or misleading information; (f) to upload or transmit viruses or any other type of malicious code.

 

Disclaimer of Warranties; Limitation of Liability

We do not guarantee, represent or warrant that your use of our service will be uninterrupted, timely, secure, or error-free. You expressly agree that your use of, or inability to use, the service is at your sole risk. In no case shall Pivit, our directors, officers, employees, affiliates, agents, contractors, or suppliers be liable for any injury, loss, claim, or any direct, indirect, incidental, punitive, special, or consequential damages of any kind, including, without limitation lost profits, lost revenue, lost savings, loss of data, or replacement costs, arising from your use of any of the service or any products procured using the service.

 

Indemnification

You agree to indemnify, defend and hold harmless Pivit and our parent, subsidiaries, affiliates, partners, officers, directors, agents, contractors, licensors, service providers, subcontractors, suppliers, interns and employees, harmless from any claim or demand, including reasonable attorneys’ fees, made by any third-party due to or arising out of your breach of these Terms of Service or the documents they incorporate by reference, or your violation of any law or the rights of a third-party.

 

Governing Law

These Terms of Service and any separate agreements whereby we provide you Services shall be governed by and construed in accordance with the laws of the State of Deleware, United States.

 

Changes to Terms of Service

You can review the most current version of the Terms of Service at any time at this page. We reserve the right, at our sole discretion, to update, change or replace any part of these Terms of Service by posting updates and changes to our website. It is your responsibility to check our website periodically for changes.
